These Terms and Conditions ("Terms") govern your use of the Aiboll platform, websites, SDK, and mobile experiences (the "Services") operated by Aiboll, Inc. ("Aiboll," "we," "us," "our"), a Delaware C-corporation. By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Who we are

Aiboll is a technology company that operates an AI-powered in-app advertising network connecting users, advertisers, and publishers. Aiboll is not a bank or a financial institution.

2. Eligibility

You must be at least 18 years old and able to form a binding contract. By using the Services you confirm you meet these requirements and that the information you give us is accurate.

3. Accounts

You are responsible for your account and credentials and for activity under your account. Keep your login secure and notify us of any unauthorized use. One account per person; multiple or fraudulent accounts may be suspended.

4. The Services

Aiboll lets users opt in to view and interact with advertising and earn rewards, lets advertisers reach opted-in audiences, and lets publishers monetize their apps. Ad participation is optional; you choose whether to opt in, and you can opt out at any time.

5. Rewards, wallet, and payouts

• Earning. You earn rewards only by genuinely engaging with opted-in ads or offers as described in the app. Rewards have no value until credited to your wallet and are not a wage, security, or guaranteed income.
• No guarantee. Availability, type, and amount of rewards may change at any time. We do not guarantee any minimum earnings.
• Wallet and payout. Rewards accrue in your in-app wallet and may be paid out through our payment provider, Stripe, once you meet the stated minimum and any verification requirements. Aiboll is not a bank; funds are handled by Stripe as a regulated payment partner under its own terms.
• Verification and tax. Where required by law, you must complete identity verification (KYC) before payout, and you are responsible for any taxes on rewards you receive.
• Forfeiture. We may withhold, reverse, or cancel rewards and close accounts where we reasonably detect fraud, bots, manipulation, multiple accounts, or breach of these Terms.

6. Acceptable use

You agree not to:

• use bots, emulators, automation, VPN masking, or other means to fake ad engagement or inflate rewards;
• create multiple or fake accounts, or sell or transfer accounts;
• reverse engineer, interfere with, or attempt to disrupt the Services or SDK;
• use the Services for any unlawful, infringing, or harmful purpose.

Breach may result in suspension, termination, and forfeiture of rewards.

7. Advertisers and publishers

Advertisers and publishers may be subject to a separate written agreement that prevails over these Terms in case of conflict. Advertisers are responsible for the legality and accuracy of their ad content; publishers are responsible for lawful integration of the Aiboll SDK and for obtaining required user consents.

8. Intellectual property

Aiboll and its licensors own the Services, software, branding, and content (excluding your own content and advertiser content). We grant you a limited, revocable, non-transferable license to use the Services for their intended purpose. You may not copy, modify, or distribute our materials without permission.

9. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or secure. Mandatory consumer-protection rights in your country of residence are not affected by this section.

10. Limitation of liability

To the maximum extent permitted by law, Aiboll is not liable for indirect, incidental, special, or consequential damages, or for lost profits or lost rewards. Our total liability for any claim is limited to the greater of the rewards paid to you in the 6 months before the claim, or USD 100. Nothing here excludes liability that cannot be excluded by law.

11. Indemnification

You agree to indemnify Aiboll against claims and costs arising from your misuse of the Services or breach of these Terms, to the extent permitted by law.

12. Termination

You may stop using the Services at any time. We may suspend or terminate your access for breach of these Terms or where required by law. On termination, unredeemed rewards obtained in good faith and meeting payout requirements remain payable; rewards linked to fraud or breach are forfeited.

13. Changes

We may update these Terms. Material changes will be notified in-app, by email, or on our website. Continued use after changes take effect means you accept them.

14. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Delaware, unless mandatory law in your country of residence (for example, EU consumer law) gives you the right to bring proceedings in your local courts.
